TERMS AND CONDITIONS

**ARTIST SHOWCASE TERMS AND CONDITIONS**

These Terms and Conditions ("Agreement") are entered into by and between The Feels Foundation, hereinafter referred to as the "Organizer," and the participating artist, hereinafter referred to as the "Artist."

By submitting an application to participate in the showcase, the Artist agrees to be bound by the terms and conditions outlined herein.

**1. APPLICATION PROCESS:**

1.1 Submission: Artists must complete the application form provided by the Organizer. All required fields must be accurately filled, and supporting materials (portfolio, biography, etc.) must be submitted as specified.

1.2 Eligibility: The Artist must meet the criteria outlined in the application guidelines. The Organizer reserves the right to disqualify any application that does not meet the eligibility criteria.

1.3 Deadline: Applications must be submitted by the specified deadline. Late submissions will not be considered.

**2. SELECTION PROCESS:**

2.1 Juried Selection: The selection of artists for the showcase will be conducted by a panel of jurors appointed by the Organizer. The decision of the jury is final and non-negotiable.

2.2 Notification: Selected artists will be notified by the Organizer via the contact information provided in their application. Unsuccessful applicants will also receive notifications.

**3. PARTICIPATION REQUIREMENTS:**

3.1 Confirmation: Selected artists must confirm their participation within the stipulated timeframe. Failure to do so may result in the selection of an alternate artist.

3.2 Artwork: Artists agree to display the agreed-upon artwork during the showcase. Any changes must be communicated and approved by the Organizer in advance.

3.3 Attendance: Artists must be present during the entire duration of the showcase unless prior arrangements are made with the Organizer.

**4. PROMOTIONAL MATERIALS:**

4.1 Authorization: By participating, artists grant the Organizer the right to use images and information provided in their application for promotional purposes related to the showcase.

4.2 Marketing Collaboration: Artists are encouraged to promote their participation in the showcase through their own channels. The Organizer may provide promotional materials for this purpose.

**5. FEES AND EXPENSES:**

5.1 Participation Fee: If applicable, artists are responsible for the payment of any participation fees as outlined in the application guidelines.

5.2 Expenses: Artists are responsible for their own travel, accommodation, and any other associated expenses unless otherwise specified in writing by the Organizer.

**6. CANCELLATION AND WITHDRAWAL:**

6.1 Cancellation by Organizer: The Organizer reserves the right to cancel or reschedule the showcase due to unforeseen circumstances. In such cases, the Organizer will make reasonable efforts to communicate changes to the artists.

6.2 Withdrawal by Artist: If an artist needs to withdraw from the showcase, they must notify the Organizer in writing as soon as possible. Participation fees, if any, are non-refundable after a certain date specified by the Organizer.

**7. LIABILITY:**

7.1 Insurance: Artists are responsible for insuring their artwork during the showcase. The Organizer is not liable for any loss, damage, or theft of artwork.

7.2 Indemnification: Artists agree to indemnify and hold the Organizer harmless from any claims, damages, or liabilities arising out of their participation in the showcase.

**8. GOVERNING LAW:**

This Agreement shall be governed by and construed in accordance with the laws of Washington. Any disputes arising out of or in connection with this Agreement shall be resolved through amicable negotiations, and if unsuccessful, through arbitration in accordance with the rules of Arbitration Service subject to selection by The Feels Foundation’s Board of Directors.

By submitting an application, the Artist acknowledges that they have read, understood, and agree to abide by these terms and conditions.
